INFORMED CONSENT NOTICE AND AGREEMENT

By proceeding to consult with a medical professional through this platform, you acknowledge and agree to the following:

  1. Purpose of Consultation:

You understand that the consultation is intended solely for obtaining a second medical opinion solely based on the information and medical records you voluntarily provide. This platform does not offer primary diagnosis, emergency care, or treatment.

  1. Nature of the Platform:

The platform is a technological intermediary that facilitates virtual consultations between users and independent, licensed medical professionals. It is not a party to the doctor-patient relationship. It does not provide medical services, nor does it assume responsibility for the professional conduct or advice of the consulting doctors.

  1. Voluntary Participation:

Your participation is entirely voluntary. You may choose to discontinue the consultation at any time or seek alternative medical opinions. You are under no obligation to act upon the advice received.

  1. Information Disclosure:

You agree to provide complete, accurate, and up-to-date medical records and information to the consulting doctor. The opinion rendered will be based solely on the materials you submit. The platform does not verify or validate the content of these materials.

  1. Professional Independence:

The medical opinion you receive reflects the independent professional judgment of the consulting doctor. The platform does not verify and / or influence, endorse, or guarantee the accuracy, completeness, or appropriateness of any medical advice provided.

  1. Verification of Credentials:

You are encouraged to independently verify the credentials and licensing status of any medical professional you consult through the platform. The platform may provide access to publicly available information but does not certify or warrant the qualifications of any doctor.

  1. Data Protection and Privacy:

Your personal and medical data will be handled in accordance with applicable data protection laws in India. You may review our Privacy Policy for more details.

  1. Risks and Limitations:

You understand that:

  • The consultation is limited by the absence of physical examination and diagnostic testing.
  • The advice provided may differ from that of your primary care provider.
  • The platform is not liable for any medical negligence, misdiagnosis, or adverse outcomes resulting from reliance on the opinion provided.
  1. Governing Law:

This agreement, including all rights, obligations, and disputes arising from or in connection with the use of this platform, shall be governed by and construed in accordance with the laws of the Republic of India. The parties agree that such governing law shall apply irrespective of the user’s or practitioner’s location or the jurisdiction from which the platform is accessed, to the fullest extent permitted by applicable conflict-of-law principles.

  1. Jurisdiction and Dispute Resolution:

In the event of any dispute, controversy, or claim arising out of or in connection with the use of this platform, the parties agree to resolve such matters through binding arbitration under the Indian Arbitration and Conciliation Act, 1996, as amended from time to time.

The seat of arbitration shall be New Delhi, India and the language of arbitration shall be English. The arbitral award shall be final and binding on the parties and may be enforced in any court of competent jurisdiction.

  1. Doctor’s Pre- Consultaion briefing:

             “Before  beginning consultation, you confirm  the following:

Understand and confirm that the Doctor concerned is providing this consultation in his/her independent professional capacity. 

Understand and confirm that this  session is being conducted solely for the purpose of offering a second medical opinion, and the Doctor’s advice is based entirely on the medical records and information you have voluntarily submitted.  

Understand and confirm that the Doctor will not be conducting any physical examination or prescribing treatment.

Understand that you are under no obligation to follow the opinion provided to you by the Doctor consulted. 

Understand that you are free to accept, reject, or seek further advice from another medical professional. 

Understand and confirm that you have understood the risks and have independently chosen to consult with the concerned Doctot through this platform; neither the Doctor nor the platform have solicited your participation.

Understand and confirm that the platform is a neutral technology facilitator and plays no role in the content, quality, or outcome of this consultation. The platform does not influence the Doctor’s opinion, nor does it assume any responsibility for the advice provided.

  • Confirm that you have read, understood, and voluntarily accept the above terms.
  • Acknowledge that this action constitutes affirmative, informed consent under applicable electronic contract laws.
  • Agree that this consent is stored as a durable electronic record and may be used as evidence of your acceptance.
  • You have read and understood this notice.
  • You have had the opportunity to ask questions and seek clarification.
  • You voluntarily consent to proceed with the consultation under the terms stated above.
